These Terms and Conditions ("Terms") govern your access to and use of our website located at www.head.co.za (the "Site"), including membership registration, event entries, official rankings, and access to regulatory resources.

By accessing or using the Site, you agree to comply with and be bound by these Terms.

1. Statutory Framework and Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with this Site shall be subject to the exclusive jurisdiction of the South African courts.

2. Regulatory Authority & Membership

  • Official Governance: As a governing body, HEAD sets, maintains, and enforces rules, regulations, rankings, and codes of conduct across Tennis, Padel, Squash, and Pickleball.
  • Affiliation & Registration: Players, clubs, coaches, officials, and members registering through the Site agree to adhere to all associated constitutions, codes of conduct, disciplinary codes, and anti-doping policies established by HEAD and its internationally affiliated sporting federations.
  • Accuracy of Information: Members are responsible for maintaining accurate personal, contact, and playing category details on their profiles.

3. Protection of Personal Information (POPIA)

We process personal information in strict accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

  • Data Collection: By registering an account, submitting tournament entries, or subscribing to communications, you consent to HEAD processing your personal data (e.g., name, ID/passport number, demographic data, ranking history, and contact details) for administrative, ranking, historical, and sporting governance purposes.
  • Publication of Rankings & Media: By participating in sanctioned events, you acknowledge that your name, match statistics, category rankings, and photographic or videographic imagery captured at sanctioned venues may be published on the Site or associated public leaderboards.

4. Intellectual Property

All content on this Site—including HEAD trademarks, logos, official rulebooks, ranking systems, graphics, text, and software—is the intellectual property of HEAD or its licensors. 5. User Conduct & Security

You agree to use the Site only for lawful purposes related to participation in or tracking of racquet sports. You agree not to:

  • Provide false or misleading information during registration or tournament entry.
  • Interfere with or breach the security infrastructure of the Site.
  • Use automated scrapers or data harvesting tools on our player databases or rankings without express authorization.

6. Limitation of Liability & Disclaimers

  • Site Availability: The Site is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to ensure operational accuracy, we do not guarantee uninterrupted or error-free access to rankings, event portals, or user profiles.
  • Sporting Liability: Participation in sanctioned racquet sports activities arranged or listed via the Site carries inherent physical risk. HEAD assumes no liability for personal injury, property damage, or financial loss incurred by individuals participating in sanctioned events, except where prohibited by South African law.
